MADERA COUNTY, Calif. — What began as a meeting between an estranged couple at a California Denny’s ended with a 38-year-old mother of four dead and her husband behind bars on a murder charge.
Brittney Moreno, whom her family identified by her maiden name, Brittney Harris, was fatally shot Sunday, Aug. 30, outside the restaurant near Avenue 18½ and Golden State Boulevard in Madera County.
Her estranged husband, 51-year-old David Moreno, was arrested approximately four hours later in Fresno County after authorities tracked down the white Toyota RAV4 he allegedly used to flee the scene.
The Madera County Sheriff’s Office classified the case as domestic-violence related.
Since the initial arrest, however, the case has taken a more serious turn.
Court records show Brittney had an active restraining order against David Moreno before the shooting. And during his first court appearance Tuesday, Moreno pleaded not guilty. Prosecutors also argued that evidence pointed toward premeditation.
The shooting outside Denny’s
Deputies received multiple reports of gunfire shortly after 11:30 a.m. Sunday.
The shooting occurred near the Denny’s restaurant at Avenue 18½ and Golden State Boulevard, west of Highway 99.
When deputies arrived, they found Brittney suffering from multiple gunshot wounds. Officers immediately began life-saving measures until emergency medical personnel arrived.
She was taken to a local hospital but later died from her injuries.
Madera County Sheriff Tyson Pogue said investigators determined that the shooting was connected to domestic violence.
According to the sheriff, Brittney and David had been eating together inside a nearby restaurant before they walked outside.
The confrontation then turned deadly.
Authorities allege David shot Brittney multiple times before fleeing the area.

A 36-mile escape
After the shooting, witnesses reported seeing David Moreno flee in a small white SUV.
Investigators identified the vehicle as a white Toyota RAV4.
The Madera County Sheriff’s Office later located the vehicle and coordinated with the Fresno County Sheriff’s Office.
Fresno County deputies, including air and ground resources, assisted in stopping Moreno near Highway 41 and Manning Avenue.
The location was approximately 36 miles from the Denny’s where Brittney had been shot.
Moreno was taken into custody without incident.
He was subsequently booked into the Madera County Jail on suspicion of murder.
His bail was set at $1 million.
The restraining order that was already in place

Those records show Brittney had an active restraining order against Moreno before she was killed.
According to reporting by ABC30, the most recent order alleged ongoing verbal, mental and emotional abuse.

A mother of four
Brittney’s death has devastated her family and community.
ABC30 reported that her family identified her as Brittney Harris, her maiden name, and described her as a mother of four.
Family members said she was known for putting others first and making sure people around her were okay.
Photographs shared with ABC30 included an image of Brittney holding flowers after graduating from Merced College’s nurse assistant program.
Her connection to Merced College went beyond being a former student.
The college said Brittney was a student and student employee at the time of her death.
The school sent a message to students, faculty and staff offering condolences to her family, classmates and coworkers and arranged grief-support opportunities for members of the campus community affected by the tragedy.
That has added another dimension to the community response.
For those who knew Brittney as a student and colleague, the shooting was not simply a distant crime story. It was the sudden death of someone who was part of their everyday community.
The meeting before the shooting
One of the most striking details investigators have released is that Brittney and David had been together inside the restaurant shortly before the shooting.
According to the sheriff’s account, the couple ate together before leaving the restaurant.
Once outside, David allegedly walked toward Brittney’s vehicle and shot her multiple times.

Authorities and local organizations have reminded people experiencing domestic abuse that assistance is available through domestic-violence hotlines and local support organizations.
What investigators still need to establish
Although Moreno has been arrested, many questions remain.
Detectives still need to establish the precise sequence of events inside and outside the restaurant.
They will also examine evidence related to the firearm, the vehicle, witness accounts and the existing restraining order.
The circumstances surrounding the couple’s decision to meet could also become important.
